SC Stays Allahabad HC's Judgement On UP Board of Madarsa Education Act

BY A STAFF REPORTER: The Supreme Court stayed the Allahabad High Court order striking down the UP Board of Madarsa Education Act, 2004 as unconstitutional on April 5, Friday.

The Supreme Court termed the finding of Allahabad High Court that the establishment of a Madarsa board breaches the principles of secularism as potentially incorrect. It also asserted that judgment would affect the 17 lakh students, and it is of the view that the direction of relocation of students to other schools was not warranted.

The Allahabad High Court struck down the UP Board of Madarsa Education Act, 2004 as unconstitutional on March 22. The Uttar Pradesh Board of Madarsa Education Act, 2004 aims to regulate and govern the functioning of Madarsas in Uttar Pradesh.
