BY A STAFF REPORTER: The Supreme Court on Monday adjudicated Bilkis Bano's petition challenging the remission of 11 criminals who were granted capital punishment in the Bilkis Bano Gangrape case during the Gujarat 2002 riots.
Gujarat High Court in August 2022 mitigated the death penalty for The 11 convicts who raped Bilkis Bano and killed her entire family including her daughter with other six members. However, the Top Court on Saturday stated that the Gujarat government was not appropriate to pass the remission order. Consequently, An SC Bench consisting of judges BV Nagarthna and Ujjal Bhuyan has begun hearing the Public Interest Litigation filed against the remission order considering it 'maintainable'
Further, the SC while reviewing the petition emphasized that the state government should avoid being discriminating when awarding remission orders.
