According to sources close to the West Bengal government, Banerjee is likely to be considered for the position after the incumbent Naparajit Mukherjee retires at the end of the month. Mukherjee, a former state director general of police has been a member of the human rights commission for two terms lasting ten years. He was also the acting chairperson of the state human rights commission.

The former chief electoral officer of West Bengal who went on to become the state chief secretary Banerjee is known to be close to the ruling party. He was re employed after his retirement as the chief information commissioner and following his tenure coming to an end, sources indicated that he is being nominated for the post. Sources also informed that Basudeb told his close confidantes that he is most likely to join as the member of the state human rights commission.
