Supreme Court pauses key provisions of Waqf (Amendment) Act 2025, including five-year practice clause, but stops short of staying the entire legislation.

New Delhi: The Supreme Court on Monday stalled the implementation of several key provisions of the Waqf (Amendment) Act, 2025, while refusing to suspend the law in its entirety. Among the provisions put on hold is the clause mandating that only individuals practising Islam for at least five years may dedicate property as Waqf.

A bench led by Chief Justice noted that the contested provisions raised serious constitutional questions, including concerns over religious freedom and equality before law. The Court, however, chose not to grant a blanket stay, allowing other sections of the amended law to remain operational until the case is decided.

Petitioners challenging the Act argued that the five-year clause was exclusionary and could invalidate genuine dedications made by new adherents to Islam. They also raised objections to changes in the structure and powers of Waqf Boards, alleging that the amendments could undermine community autonomy.
