Kolkata: Advocate Arka Kumar Nag on Tuesday elaborated on a complaint filed by TMC leader Kalyan Banerjee against West Bengal Governor CV Ananda Bose, alleging that the Governor has been using Raj Bhavan to carry out actions that could undermine law and order in the state. Addressing the media, Nag said Banerjee’s complaint details a series of alleged statements and activities attributed to the Governor that, according to him, threaten the peace and stability of West Bengal.
Nag stated that the complaint asserts the Governor has made “direct attacks on the state of Bengal, its infrastructure, and its law and order,” and claimed such conduct “is tantamount to treason.” Stressing that the complaint targets the individual and not the constitutional office, he said, “The post of Governor is highly respected, and we all hold the Constitution in the highest esteem. But if someone occupying this post uses it for negative purposes or criminal activities, it must be stopped.”
According to Nag, the complaint invokes Sections 61, 152, 163, 194 and 353 of the Bharatiya Nyaya Sanhita (BNS), which include provisions related to treason, incitement, and attempts to create public unrest. He said these sections cover allegations of spreading misinformation, provoking instability, and making statements that could erode public trust in law enforcement.
“We have provided all the details about what the Governor said in the media,” he added, noting that the complaint includes references to purported remarks where the Governor described the police as “predators.” Nag emphasised that the accusations were “serious in nature” and warranted legal scrutiny.
